I'm sorry, but that SERIOUSLY sounds like discrimination... If it's one thing to not cover due to they don't cover a specific procedure, that's one thing. But to use that single word to say why, they've opened up can of woopa$$.

Yet...how much you wanna bet that the company is gonna argue that, since the discrimination laws don't cover transgenderism (that I know of), they're actually not doing anything illegal?

And someone, PLEASE say that I'm wrong in my assumption about discrimination laws. =-.-=

Which they don't, so it's not ILLEGAL discrimintation.

Besides, the insurance company doesn't want to pay for that, and they have an army of lawyers to convince a judge why shouldn't have to, and you have uh, not as many lawyers (and no money!). Guess who wins.

All my doctors were lying about it, I'm not sure how they figured it out. My doc was listing it as for hormonal imbalances and hypogonadism etc.

and sadly this is correct, it is how Insurance companies work. At times I feel they are as bad the IRS (or worse) but without them we would all be living back in the Stone ages in terms of economically. Insurance (though not as it is known now) has been around since back in the Roman days, modern insurance dates to that of the Colonial period (I think). Medical insurance however is fairly recent though (last 100 years or so) as before you either had to be rather wealthy to afford a doctor or they just threw you in the 'State' Hospital (insane asylum).

Ever since I got cut off my parent's policy (due to age) I haven't been able to get any insurance here due to my "pre-existing" condition (which is a genetic disorder similar to that of Cystic Fibrosis and has a high kill rate though it seems I am lucky in that regard), I can't even apply to social security because of it (I have tried as well, twice: once for myself and once by going though my mother's social security benefits)

I recieved a similar reply from my medical insurance (Medi-Cal, through California state). They said top surgery wasn't medically neccesarry because it was clear it was solely for transsexualism, even though by law they had to cover it and even though my request was accompanied by tests from docs saying my chest size was reponsible from chronic back pain, numbness in shoulders, et cetera. Woulda saved them a lot of money in psych bills over the year that I fought the denial...& I won.

But yes, you are right: open discrimination against transpeople is allowed, even celebrated, in the US. I would fight the denial. Contact The Transgender Law Center (www.transgenderlawcenter.org I think that's right.). They might point you to services in your area ( their equivalent...they're based in Cali, but I dunno if services are exclusive to people in Cali or not...nor where you reside) or have suggestions...they're pro-bono (free), by the way.

*hug* If you can, don't let them get away with this, go unchall;enged. No one deserves that. I'm so so sorry that happened. *bug hugs*
